Cases From Our Birmingham Practice

A family firm and an account nobody would query

A second-generation building supplies business found roughly eleven thousand pounds unaccounted for across a year. Three family members had signing rights and none of them could be asked directly without ending Sunday lunches for good. The founder eventually put it to all three, including himself, that they each sit an examination on the same questions. All agreed. The finding pointed to none of them and instead to a payment routine that a long-serving office manager had been operating on an instruction given verbally in 2019 and never revisited. The firm stayed a family one.

A consignment that left the workshop

A small workshop lost a consignment of finished pieces somewhere between the bench and the courier. Four people had handled it, the insurer wanted a police report, and the owner did not want to put four names in front of the police on the strength of a gap in a ledger. Three of the four asked for the examination themselves once it was offered. The session narrowed the window to a collection slot and to a courier's driver who was never an employee at all, which is where the insurer's investigation then went.

An anonymous letter three weeks before a wedding

A letter arrived at a bride's parents' house making a specific allegation about the groom. It named nothing that could be checked and everything that could not be forgotten. The couple came in together, wrote four questions with the examiner over an hour and a half, and he sat the test that afternoon. The result did not identify who sent the letter — that was never within reach — but it took the allegation off the table well enough for two families to sit on the same side of a church.

Fuel cards at a haulage yard

A haulier with nine vehicles was seeing fuel spend drift about fifteen per cent above what the mileage justified. Telematics showed nothing conclusive and accusing drivers without proof would have emptied the yard in a fortnight. The company offered voluntary examinations, stated plainly in writing that declining carried no consequence, and seven of nine took them up. Two of the seven were the source, and both left by agreement. What mattered as much to the owner was that the other five stopped feeling watched.

Confidentiality and Consent

Private testing undertaken voluntarily is lawful, and what you are left holding is a signed document from a certified examiner. The courts of England and Wales do not, however, regard lie detector findings as evidence in the ordinary sense, and no such report will carry a case by itself. Can the result be used in a UK court?

Not in the way ordinary evidence is used. Polygraph findings do not have that standing before the courts of England and Wales, and a report by itself will not resolve anything a judge has to decide. Its real value is corroborative: put beside other material, particularly in disputes and negotiations settled privately, it carries weight. Anyone facing possible proceedings should agree the format with their solicitor first.

Can my employer make me take a test?

They cannot. The offer may be made; the obligation cannot be created. Consent has to be informed, written and freely given, and a refusal proves nothing whatsoever about the person refusing. If the consent in front of us looks manufactured we hand the instruction back — and we make that point to the employer, never to the member of staff.

Can a teenager be tested?

Only where a parent or guardian has consented in writing, stays in the room for the duration, and the young person is willing. Quite often the interview makes clear that what is really being asked about is a conflict within the family rather than a question a test could settle — when that happens we say so and recommend against going any further.

Can the test be done online?

It can, for £150, and that is generally how cases spanning two countries are handled. Neither the interview nor the consent procedure differs. Our advice where an in-person appointment is feasible is still to take it — a camera gives the examiner a head and shoulders, not a person.
